Terms of Service

By accessing or using the website makemygarden.ae, contacting us via WhatsApp, telephone, or email, or engaging any of our services, you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Hyperclean Technical Services LLC, operating under the trade name Make My Garden® ("Company," "we," "us," or "our").

If you do not agree with any provision of these Terms, you must not use our website or engage our services. These Terms apply in addition to any written quotation or project agreement issued by Make My Garden®.

These Terms are governed by the laws of the United Arab Emirates, including but not limited to UAE Federal Law No. 5 of 1985 (Civil Transactions Law, as amended), UAE Federal Law No. 15 of 2020 (Consumer Protection Law), and all applicable regulations issued by the Dubai Department of Economy and Tourism.

Make My Garden® is a premium landscaping and outdoor living brand operated by Hyperclean Technical Services LLC, a company duly registered and licensed by the Dubai Department of Economy and Tourism (DET). We specialise in residential and commercial landscaping design, swimming pool construction, garden maintenance, and outdoor living solutions across Dubai and Abu Dhabi.

All projects are executed by our in-house team of designers, horticulturists, pool engineers, and skilled tradespeople. We hold the necessary trade licences and municipal approvals to carry out landscaping and construction works in the Emirate of Dubai.

Make My Garden® offers the following categories of services, subject to availability and project feasibility:

• Landscaping Design and Construction — Garden design, villa landscaping, hardscaping, softscaping, irrigation systems, outdoor lighting, pathways, and retaining walls
• Swimming Pool Construction — Custom pool design and construction, infinity pools, plunge pools, jacuzzis, pool tiling, pool equipment, and water features
• Outdoor Structures — Pergolas, gazebos, outdoor kitchens, BBQ areas, decking, and shade structures
• Artificial Grass Installation — Supply and installation of premium artificial turf for gardens, rooftops, and commercial spaces
• Garden Maintenance — Scheduled garden maintenance contracts, lawn care, pruning, fertilisation, pest management, and irrigation maintenance
• Pool Maintenance — Weekly and monthly pool maintenance contracts, water chemistry balancing, equipment servicing, and emergency repairs

All services described on our website are indicative. Every project is unique, and the precise scope, specifications, and pricing for your project will be determined following a mandatory site visit and documented in a written quotation. No work will commence without a signed and approved quotation.

Written Quotations

All quotations issued by Make My Garden® are provided in writing (via email or printed document) and include a detailed breakdown of materials, labour, and scope of work. We provide fixed-price quotations — the approved price is the price you pay, with no hidden charges.

Validity Period

Unless otherwise stated, all quotations are valid for 30 calendar days from the date of issue. After this period, pricing may be subject to revision due to changes in material costs, supplier pricing, or exchange rate fluctuations.

Inclusions and Exclusions

Each quotation clearly specifies what is included (materials, labour, design, project management) and what is excluded (authority approval fees, community approval fees, soil testing, structural engineering reports, or any items not explicitly listed). If you require additional items not covered in the original quotation, we will issue a variation order with a separate price for your approval before proceeding.

Variation Orders

Any changes to the approved scope of work — whether requested by you or necessitated by site conditions discovered during construction — will be documented in a written variation order. Variation orders must be approved and signed by you before the additional work is carried out. The variation order will specify the additional cost (or credit) and any impact on the project timeline.

Pricing Disclaimer

Prices displayed on our website, social media, or marketing materials are for indicative purposes only and do not constitute a binding offer. The final price for your project will be determined by the written quotation issued after a site visit.

Payment Structure

Unless otherwise agreed in writing, the following payment schedule applies to all projects:

• 50% deposit — Due upon approval of the quotation and before work commences. This deposit secures your project date, allows procurement of materials, and initiates the authority approval process where applicable.
• 50% balance — Due upon completion of the project and before final handover. Completion is defined as the moment the project passes our quality inspection and walkthrough with you.

For large-scale projects exceeding AED 150,000, a milestone-based payment schedule may be agreed in writing between both parties.

Accepted Payment Methods

We accept payment by bank transfer, cheque, and cash (subject to UAE Central Bank cash transaction limits). Credit card payments may be arranged on request and may be subject to a processing surcharge.

Late Payment

If payment is not received within 7 calendar days of the due date, we reserve the right to suspend work on your project until full payment is received. We may charge a late payment fee of 1.5% per month on any outstanding balance, calculated from the original due date. Persistent non-payment may result in the matter being referred for debt recovery in accordance with UAE law.

We commit to a project timeline in writing as part of our quotation or project agreement. Our team provides daily photo updates and progress reports throughout the construction phase so you always know the status of your project.

While we make every effort to complete your project within the agreed timeframe, certain delays may occur that are beyond our reasonable control, including but not limited to:

• Delays in authority approvals (Dubai Municipality, DDA, TRAKHEES)
• Delays in community approvals (EMAAR, NAKHEEL, DAMAC, Meraas, or other master developers)
• Extreme weather events (sandstorms, heavy rainfall, excessive heat exceeding safe working conditions)
• Supply chain disruptions or material shortages
• Changes requested by you after work has commenced
• Force majeure events (see Section 13)

In the event of any delay, we will inform you promptly, provide a revised timeline, and take all reasonable steps to minimise the impact on your project.

Many landscaping and pool construction projects in Dubai require approval from government authorities and community management before work can begin. Make My Garden® manages the entire approval process on your behalf, including:

• Dubai Municipality (DM) — For properties within Dubai Municipality jurisdiction
• Dubai Development Authority (DDA) — For properties within DDA-governed areas
• TRAKHEES — For properties in free zone areas governed by TRAKHEES (Jebel Ali, Palm Jumeirah, etc.)
• Master developer approvals — EMAAR, NAKHEEL, DAMAC, Meraas, Dubai Properties, and other community management offices

Client cooperation: You are required to provide all necessary documents (title deeds, NOCs, property plans, access permissions) in a timely manner to facilitate the approval process. Delays in providing these documents may affect the project timeline.

Approval fees: Government and community approval fees are payable by the Client and are typically excluded from our quotation unless explicitly stated otherwise.

No guarantee of timeline: While we have extensive experience with Dubai's approval processes, the timeline for authority approvals is determined by the respective authorities and is outside our control. We cannot guarantee a specific approval date but will pursue every available avenue to expedite the process.

Make My Garden® provides a 1-year workmanship warranty on all completed projects, commencing from the date of project handover. This warranty covers:

What Is Covered

• Defects in workmanship (construction quality, installation integrity, finishing)
• Structural issues arising from our construction (retaining walls, pool shell, pergola structures)
• Irrigation system malfunctions caused by installation defects
• Pool plumbing and equipment issues resulting from installation defects
• Plant replacement for specimens that fail within the first 90 days due to factors within our control (subject to a maintenance contract being in place or documented proper care by the Client)

What Is Not Covered

• Normal wear and tear
• Damage caused by misuse, negligence, or failure to follow the care guide provided at handover
• Damage caused by natural disasters, extreme weather events, or acts of God
• Modifications, alterations, or repairs made by third parties without our written consent
• Plant loss due to inadequate watering, improper care, pest infestation, or disease (unless a maintenance contract with Make My Garden® is active)
• Issues with materials or equipment covered by separate manufacturer warranties (which we will assist you in claiming)
• Cosmetic changes in natural stone, wood, or other materials that occur naturally over time (patina, colour variation, weathering)

Warranty Claims

To make a warranty claim, contact us at info@makemygarden.ae or +971 52 786 9214 with a description and photographs of the issue. We will inspect the reported issue within 7 business days and, if covered, carry out remedial work at no additional cost within a reasonable timeframe.

To the fullest extent permitted by UAE law:

• Make My Garden® shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services, including but not limited to loss of profits, loss of use of property, business interruption, or loss of anticipated savings.
• Our total aggregate liability for any claim arising from a project shall not exceed the total value of the quotation approved for that specific project.
• We shall not be liable for any damage to underground utilities, pipes, cables, or structures that were not disclosed to us or visible during the site survey, unless caused by our demonstrable negligence.
• We shall not be liable for delays, losses, or damages caused by force majeure events as defined in Section 13.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded under UAE Federal Law No. 5 of 1985.

Project Designs and Renders

All landscape designs, architectural drawings, 3D renders, planting plans, and related creative materials produced by Make My Garden® remain our intellectual property until full payment has been received for the project. Upon receipt of full payment, you receive a non-exclusive licence to use the designs for the specific project and property for which they were created.

Designs may not be shared with, sold to, or used by third parties — including other contractors — without our written consent. Designs provided during the quotation stage remain our property regardless of whether you proceed with the project.

Website Content

All content on makemygarden.ae — including text, photographs, graphics, logos, videos, and code — is the property of Hyperclean Technical Services LLC and is protected by UAE copyright law and international intellectual property treaties. You may not reproduce, distribute, modify, or create derivative works from our website content without our prior written permission.

Portfolio Rights

By engaging our services, you grant Make My Garden® the right to photograph, film, and display completed projects in our portfolio, website, social media, and marketing materials, unless you notify us in writing that you do not wish your project to be featured.

To enable Make My Garden® to deliver your project efficiently and to the agreed standard, you agree to:

• Provide site access — Ensure our team has unobstructed access to the project site during agreed working hours, including vehicle access for material deliveries and equipment
• Provide accurate information — Share truthful and complete information about your property, including any known underground utilities, existing drainage issues, property boundaries, and relevant title deed restrictions
• Make timely decisions — Respond to design approvals, material selections, and variation orders within a reasonable timeframe to avoid project delays
• Maintain the site during construction — Ensure children, pets, and unauthorised persons do not enter the construction zone for safety reasons
• Provide required documents — Supply title deeds, NOCs, property plans, and any other documents required for authority and community approvals in a timely manner
• Follow the care guide — After handover, follow the personalised garden care guide provided by our team to maintain the health and appearance of your landscape and preserve your warranty
• Make payments on time — Adhere to the agreed payment schedule as outlined in Section 5

Failure to fulfil these obligations may result in project delays, additional costs, or reduced warranty coverage, and Make My Garden® shall not be held liable for any consequences arising from such failure.

Cancellation Before Work Commences

If you cancel your project after paying the deposit but before any physical work has commenced on site, we will refund your deposit minus a 15% administrative fee to cover design time, site surveys, approval preparation, and material procurement initiated on your behalf. If materials have already been ordered, the cost of non-returnable materials will also be deducted from the refund.

Cancellation After Work Commences

If you cancel your project after physical work has commenced, you will be liable for:

• The full cost of all work completed to date
• The cost of all materials ordered, delivered, or installed
• The cost of any authority approval fees incurred
• A reasonable sum for demobilisation and site restoration

We will provide a detailed breakdown of costs within 14 business days of receiving your cancellation notice. Any balance from your deposit after deducting the above costs will be refunded within 30 calendar days.

Cancellation by Make My Garden®

We reserve the right to cancel or suspend a project in the following circumstances: non-payment or persistent late payment; failure by the Client to provide site access or required documents; discovery of structural, legal, or safety issues that make the project unfeasible; or force majeure events. In such cases, we will notify you in writing and provide a fair accounting of work completed and refunds due.

Neither party shall be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond its reasonable control ("Force Majeure Event"), including but not limited to:

• Extreme weather events (sandstorms, flooding, cyclones, temperatures exceeding safe working conditions)
• Epidemics, pandemics, or public health emergencies
• Government orders, restrictions, curfews, or changes in regulation
• War, civil unrest, terrorism, or sanctions
• Supply chain disruptions, international shipping delays, or material shortages
• Utility failures (power outages, water supply interruptions)
• Labour disputes or strikes affecting our suppliers or subcontractors

In the event of a Force Majeure Event, the affected party shall notify the other party as soon as reasonably practicable. The project timeline will be extended by a period equivalent to the duration of the Force Majeure Event. If the Force Majeure Event continues for more than 90 consecutive days, either party may terminate the agreement by written notice, and a fair settlement will be reached for work completed and materials procured.

Negotiation

In the event of any dispute arising from or in connection with these Terms, your project, or our services, both parties agree to first attempt to resolve the matter through good-faith negotiation. Either party may initiate the process by sending a written notice describing the dispute to the other party. Both parties shall use reasonable endeavours to resolve the dispute within 30 calendar days of the notice.

Jurisdiction

If the dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the Courts of Dubai, United Arab Emirates. Both parties consent to the jurisdiction of the Dubai Courts and waive any objection to venue.

Governing Law

These Terms, and any dispute or claim arising from or in connection with them, shall be governed by and construed in accordance with the laws of the United Arab Emirates, including UAE Federal Law No. 5 of 1985 (Civil Transactions Law) and UAE Federal Law No. 18 of 1993 (Commercial Transactions Law), as amended.

When using makemygarden.ae, you agree to:

• Use the website for lawful purposes only
• Not attempt to gain unauthorised access to any part of the website, its servers, or any connected database
• Not use automated tools, bots, scrapers, or similar technology to extract content, data, or information from the website without our written permission
• Not reproduce, mirror, or frame any part of our website on another website
• Not transmit any viruses, malware, or harmful code through our contact forms or other website features

Accuracy of content: While we take reasonable care to ensure the information on our website is accurate and up to date, we do not warrant that all content is error-free or complete. Project descriptions, portfolio images, and service descriptions are for illustrative purposes. Your specific project will be governed by the written quotation.

Pricing calculator disclaimer: If our website includes a pricing calculator, cost estimator, or budget guide, the figures provided are approximate estimates only and do not constitute a binding quotation. Actual project costs depend on site conditions, design complexity, material selection, and scope of work, and will be confirmed in a written quotation following a site visit.

Our website may contain links to third-party websites, including but not limited to material suppliers, authority portals, social media platforms, and industry associations. These links are provided for your convenience and information.

Make My Garden® does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. You access third-party websites at your own risk, and we encourage you to review the terms and privacy policies of any website you visit.

Make My Garden® reserves the right to update, amend, or replace these Terms at any time. When we make changes:

• The "Last Updated" date at the top of this page will be revised
• The updated Terms will be published on makemygarden.ae
• For material changes that affect ongoing projects, we will notify affected Clients directly via email or WhatsApp

Your continued use of our website or services after the publication of revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, please discontinue use of our website and contact us to discuss any ongoing project arrangements.

Changes to these Terms do not affect the terms of any written quotation or project agreement already signed and in effect, unless both parties agree in writing.

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction in the United Arab Emirates, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent and economic effect of the severed provision.

These Terms and Conditions, together with our Privacy Policy and any written quotation or project agreement signed between you and Make My Garden®, constitute the entire agreement between the parties regarding the subject matter hereof.

These Terms supersede all prior or contemporaneous oral or written communications, proposals, representations, and agreements between the parties. No verbal agreement, promise, or representation made by any employee or agent of Make My Garden® shall be binding unless confirmed in writing by an authorised representative of the Company.

In the event of any conflict between these Terms and a written quotation or project agreement, the written quotation or project agreement shall prevail to the extent of the conflict.
